Rio de Janeiro Court Reinstates Suspension of Eagle’s Powers at Botafogo, Contradicting Arbitral Ruling

A court in Rio de Janeiro has once again suspended the voting rights of Eagle Bidco, the company that holds 90% of Botafogo’s SAF, and confirmed Durcesio Mello as the head of the club’s corporate entity. The decision, issued by the 2nd Business Court of the Capital, contradicts a ruling from the Fundação Getulio Vargas (FGV) Arbitral Tribunal, which on Monday had reinstated Eagle’s rights and deemed Mello’s election and appointment irregular.

Judge Marcelo Mondego de Carvalho Lima upheld the suspension initially imposed on April 28, keeping the club’s association as the only eligible voter in the Extraordinary General Assembly scheduled for May 14. The news was first reported by “Canal do TF” and confirmed by Lance!.

The FGV Arbitral Tribunal had earlier determined a positive conflict of jurisdiction over Eagle’s voting rights and referred the matter to the Superior Court of Justice (STJ). It also restored Eagle’s political rights within the SAF and suspended any corporate actions taken without the holding company’s participation.

The new state court decision keeps Durcesio Mello as the director-general of Botafogo’s SAF, defying the arbitration ruling that questioned the legality of his appointment.

Botafogo’s Extraordinary General Assembly is set for Thursday, May 14, with the first call scheduled for 11 a.m. If quorum is not met, a second call will be held on May 19.
